Sanibel Baby Rentals, LLC – Rental Terms
Your rental is not confirmed until payment is received. An invoice will be sent within 72 hours once all terms are met.
By proceeding, you agree to the following:
Please return all items in the same clean condition you received them. Items requiring deep cleaning will incur an additional fee.
Only Beach Items can go to the beach, please rinse off sand and salt water as best you can. Please do not take play-yards or non-beach toys to the beach.
Our cancellation policy is:
Full refund more than 7 days in advance
50 percent refund 2 to 7 days in advance
No refund within 48 hours
Sanibel Baby Rentals LLC Liability Waiver and Release Agreement
This Liability Waiver and Release Agreement ("Agreement") is entered into by and between Sanibel Baby Rentals LLC ("Company," "We," or "Our") and the undersigned ("Customer," "You," or "Your"). By signing this Agreement, you acknowledge and agree to the following terms and conditions related to the rental of baby equipment and services from Sanibel Baby Rentals LLC.
1. Acknowledgement of Risk You acknowledge and understand that the use of baby equipment, including but not limited to cribs, strollers, car seats, high chairs, and other related items ("Equipment") involves certain inherent risks, including potential injury to children or others due to improper use, malfunction, or failure to follow safety instructions. You further acknowledge that you have received and understand the manufacturer's instructions for each piece of Equipment.
2. Assumption of Risk By renting Equipment from Sanibel Baby Rentals LLC, you voluntarily assume all risks and liabilities associated with the use of such Equipment, whether caused by negligence or otherwise. This includes, but is not limited to, any injury to persons or property, including your child(ren), during the rental period.
3. Release of Liability To the fullest extent permitted by law, you hereby release, waive, discharge, and agree to hold harmless Sanibel Baby Rentals LLC, its owners, employees, agents, affiliates, and contractors from any and all claims, liabilities, damages, or expenses arising from or related to the use of the rented Equipment. This release applies to any injury, damage, or loss incurred by you or your child(ren) while using the Equipment.
4. Indemnification You agree to indemnify, defend, and hold harmless Sanibel Baby Rentals LLC, its officers, employees, agents, and affiliates from any and all claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising out of or in connection with your use of the Equipment, including any claims made by third parties.
5. Equipment Condition and Return You confirm that upon receipt, you have inspected the Equipment and it is in good condition and safe for use. If any Equipment is found to be defective or damaged during the rental period, you agree to immediately cease using it and notify Sanibel Baby Rentals LLC. You agree to return the Equipment on the agreed date and in the same condition as when it was received. Any parts not returned shall be charged to you at present selling price. Customer shall not loan, sub-let, mortgage or in any other manner dispose of same to any other person without written consent of owner.
6. Severability If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
7. Cancellation Policy: The cancellation policy offers a full refund if canceled more than 7 days in advance, a 50% refund if canceled two to seven days before, and no refund within 48 hours of rental.
8. Venue and Governing Law:
The parties agree that this waiver and release agreement will be interpreted and enforced in accordance with the laws of the State of Florida. Any legal action or dispute arising out of or related to this waiver and release agreement shall be exclusively brought in the state courts of Florida, which shall have sole jurisdiction and venue. The parties consent to the exclusive jurisdiction of these courts and waive any objection to such venue.
9. Entire Agreement This Agreement constitutes the entire agreement between you and Sanibel Baby Rentals LLC concerning the rental of Equipment. Any amendments to this Agreement must be in writing and signed by both parties.
By making payment, you acknowledge that you have read, understood, and voluntarily accept the terms and conditions of this Liability Waiver and Release Agreement.
